The terms that govern your use of MyJob.mt. Last updated: 24 May 2026.
1. Definitions
In these Terms & Conditions (“Terms”), the following definitions apply:
- “Site” means the website located at MyJob.mt, including all subdomains, pages, features, and services accessible through it.
- “Company”, “we”, “us”, or “our” means MyJob.mt, the operator of the Site, registered in Malta.
- “User” or “you” means any individual or entity accessing or using the Site, whether as a Recruiter or a Candidate.
- “Recruiter” means any individual, company, recruitment agency, or other entity that posts or purchases a Job Listing on the Site. Recruiters use the Site in the course of their trade, business, craft, or profession.
- “Candidate” means any individual who browses, searches, or applies to Job Listings on the Site.
- “Job Listing” or “Listing” means any job advertisement, vacancy notice, or employment opportunity published on the Site by a Recruiter.
- “Alert”means a saved set of tag criteria a Candidate configures on the Site to receive AI-matched email notifications when new Job Listings matching that criteria are published. Alerts are delivered at a cadence (weekly, daily, or hourly) determined by the Candidate's active entitlements.
- “Alert Time-Block” means a one-time, non-recurring purchase that grants a Candidate access to a specific Alert delivery cadence (currently daily or hourly) for a fixed duration (currently 30 days). Alert Time-Blocks are not subscriptions, do not auto-renew, and do not require cancellation. Pricing, cadences, and durations are as displayed on /pricing/job-seekers at the moment of purchase.
- “Service” means the publication of a Job Listing on the Site for the applicable listing duration and, where purchased, the delivery of Alert emails at the cadence granted by an active Alert Time-Block (or the free weekly digest). The Service consists solely of making Listings publicly accessible on the Site and (for Candidates with an active Alert) of operating the alert-matching pipeline. It does not include recruitment, applicant delivery, candidate screening, employment placement, or any guarantee of results.
- “Delivery”means the moment at which a Job Listing is published and made publicly accessible on the Site, as confirmed by automated email notification to the Recruiter's registered email address. Such notification constitutes conclusive evidence of Delivery and full performance of the Service.
2. Agreement to terms
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Site. These Terms constitute a legally binding agreement between you and the Company.
We reserve the right to modify these Terms at any time. Recruiters will receive at least fifteen (15) days' advance notice of material changes via email or on-site notification. Changes take effect upon the expiry of the notice period. Continued use of the Site after the effective date constitutes acceptance. If you do not agree to revised Terms, your sole remedy is to stop using the Site. For non-material changes or changes to Candidate-facing features, updates take effect immediately upon posting.
3. Business capacity representation
By purchasing a Job Listing, the Recruiter represents and warrants that they are acting for purposes relating to their trade, business, craft, or profession and are not acting as a consumer within the meaning of EU Directive 2011/83/EU or any equivalent Maltese legislation.
The Recruiter acknowledges that the transaction is a business-to-business (B2B) transaction and that consumer protection rights, including but not limited to the 14-day right of withdrawal under the Consumer Rights Directive, do not apply to purchases made on the Site.
Without prejudice to the foregoing, and purely as a precautionary measure: by completing a purchase, the Recruiter expressly requests that the Service be performed immediately upon payment and expressly acknowledges that they lose any right of withdrawal once the Job Listing has been published (i.e. once Delivery has occurred), in accordance with Article 16(a) of Directive 2011/83/EU and Regulation 28(1)(a) of Malta's Consumer Rights Regulations (S.L. 378.17).
4. Description of service
MyJob.mt is an online job board focused on employment opportunities in Malta and Gozo. We provide a platform where Recruiters can publish Job Listings and where Candidates can browse those Listings.
We operate as a venue and platform only. We are not an employer, recruitment agency, staffing agency, employment intermediary, or labour hire company. We do not participate in the hiring process, do not vet or verify employers or candidates, do not screen applications, and do not guarantee that any Job Listing will result in employment or that any Candidate will be suitable for a role.
The Service we provide to Recruiters consists exclusively of the publication of a Job Listing on the Site for the applicable listing duration. The Service does not include or guarantee any specific number of views, clicks, applications, or hires. Any statistics, analytics, or metrics displayed on the Site are provided for informational purposes only and do not form part of the Service.
5. Eligibility
You must be at least 16 years old to use the Site. By using the Site, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
Recruiters must additionally represent that they have the authority to act on behalf of the organisation for which they are posting and that they have obtained all necessary authorisations to do so.
6. User accounts
Certain features require you to create an account via Google OAuth. These include, without limitation: posting Job Listings, accessing application links or recruiter contact details on any Listing in order to apply, creating or managing Alerts, purchasing Alert Time-Blocks, saving jobs, and following companies. Browsing and searching Listings does not require an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use.
We reserve the right to suspend or terminate any account at any time, at our sole discretion, without prior notice or liability. Suspension or termination of an account does not entitle the Recruiter to any refund of fees already paid.
7. Job listings: Recruiter obligations
By posting a Job Listing on the Site, the Recruiter represents, warrants, and undertakes that:
- The Listing is for a genuine, currently open position and is not misleading, fraudulent, deceptive, or discriminatory.
- One Listing represents one role.Each paid Listing must advertise a single, specific, currently open position with a defined job title, scope, and (where applicable) location. The Recruiter shall not use a single Listing as a catch-all advertisement for multiple roles, role families, departments, or “any open position”, and shall not use a Listing primarily as a redirect to a generic careers page, talent pool, application form, or expression-of-interest form covering roles other than the one described in the Listing. To advertise multiple positions, the Recruiter must purchase a separate Listing for each position. The Company may grant a written exemption (for example for an evergreen requisition or an explicitly named talent-pool campaign) at its sole discretion; such exemption must be obtained in advance by emailing hello@myjob.mt and is valid only for the specific Listing and period stated in our written reply.
- The Recruiter is duly authorised to post the Listing on behalf of the hiring organisation and has obtained all necessary consents.
- All information provided (including but not limited to company name, trading name, salary, location, job title, and job description) is accurate, current, and not misleading.
- The Listing complies with all applicable laws, including but not limited to EU and Maltese employment law, the Employment and Industrial Relations Act (Cap. 452), the Equal Treatment in Employment Regulations (S.L. 452.95), anti-discrimination legislation, and GDPR.
- The Listing does not promote multi-level marketing, pyramid schemes, commission-only roles disguised as employment, or any unlawful activity.
- The Recruiter is solely responsible for the content, accuracy, and legality of the Listing, and the Company bears no responsibility whatsoever for the same.
We reserve the right to remove, modify, refuse, or limit the visibility of any Listing at our sole discretion, without refund, without notice, and without liability, if we believe it violates these Terms, any applicable law, or is otherwise objectionable or harmful to the Site, its users, or the public.
8. Listing payments, pricing & no refunds
Job Listing publication requires a one-time payment at the price displayed at the time of purchase, currently €49 per Listing. All prices are inclusive of VAT where applicable. Payments are processed securely by Stripe. The Company does not store your payment card details.
All Listing payments are final, non-refundable, and non-transferable. Once payment has been submitted and processed, no refund, credit, discount, or compensation of any kind will be issued under any circumstances, including but not limited to:
- The Recruiter changing their mind after purchase.
- The position being filled, withdrawn, cancelled, or modified after publication.
- Dissatisfaction with the number, quality, or suitability of applicants received (or receiving no applicants at all).
- Errors, omissions, or inaccuracies in the Listing content submitted by the Recruiter.
- The Listing being removed by us for violating these Terms or applicable law.
- Technical issues on the Recruiter's side preventing them from managing the Listing.
- The Site being temporarily unavailable due to maintenance, outages, or other interruptions.
- The Recruiter's account being suspended or terminated for breach of these Terms.
By completing a purchase, you expressly acknowledge and agree to this no-refund policy. We reserve the right to change pricing at any time; however, price changes will not affect Listings already purchased.
9. Alert time-block purchases: Candidate billing
In addition to one-time Listing purchases for Recruiters, the Site offers optional paid Alert Time-Blocks for Candidates. Each Alert Time-Block is a one-time, non-recurring purchase that grants access to a specific Alert delivery cadence for a fixed duration. Current options are €2 for 30 days of daily delivery and €5 for 30 days of hourly delivery, as displayed on /pricing/job-seekers. A free weekly digest is also available to any Candidate with an Alert configured, with no payment required and no expiry. Pricing, cadences, and durations may change at any time and are governed by the version displayed on the pricing page at the moment of purchase. We reserve the right to add, remove, or re-price Alert Time-Block options without notice or compensation. Changes do not affect Time-Blocks already purchased.
No subscription, no auto-renewal, no cancellation.Alert Time-Blocks are one-time purchases. Once the stated duration elapses, the entitlement expires automatically and the Candidate's card is not charged again. There is no recurring billing, no payment-method retention for renewal purposes, no cancellation flow, and nothing for the Candidate to opt out of. To continue receiving Alert emails at a paid cadence after expiry, the Candidate must purchase another Time-Block at the then-current price. After expiry, the Candidate retains the free weekly digest by default.
Additional purchases extend duration. If a Candidate purchases an additional Time-Block for a cadence they already have active, the new duration is added to the end of the existing entitlement (the later of the current expiry or the moment of purchase, plus the new duration). Purchasing again before expiry therefore extends total access rather than overlapping with the existing period. Purchases of different cadences create separate entitlements that run in parallel.
All Alert Time-Block payments are final, non-refundable, and non-transferable. Once payment has been submitted and the entitlement has been granted, no refund, credit, discount, pro-rated reimbursement, or compensation of any kind will be issued under any circumstances, including but not limited to:
- The Candidate no longer using the matching or email-delivery features.
- The Candidate's preferred role not appearing in any matching email during the entitlement period.
- Account suspension or termination for breach of these Terms.
- Site downtime, delivery delays, deliverability failures, or technical issues on our side or our processors' side.
- Changes to the matching algorithm, supported tags, delivery cadences, or pricing of future Time-Blocks.
- The Candidate purchasing a Time-Block while another entitlement is still active (stacking is intentional, not a refund event).
- The Candidate's Alert configuration not producing matches that they consider relevant.
Free weekly digest. Any Candidate who has saved an Alert receives a free weekly digest of matching Listings at no cost. The free weekly digest does not require any purchase and is not tied to an Alert Time-Block. We may pause, modify, or discontinue the free weekly digest at any time with reasonable on-site notice. No compensation is owed for any pause, modification, or discontinuation of the free weekly digest.
Use of alert data.By creating, configuring, or maintaining an Alert (whether or not an Alert Time-Block is purchased), the Candidate acknowledges and agrees that we may use the Alert's configuration (including tag selections, cadence, name, and match history) and aggregate engagement metrics (including open rates, click rates, conversion rates, and listing-match patterns) for the following purposes:
- Operating, monitoring, improving, and debugging the matching and delivery pipeline.
- Training, evaluating, and tuning our AI tagging and matching models.
- Producing aggregated, de-identified analytics, dashboards, and reports for internal use, investor reporting, partner reporting, and external marketing communications.
- Personalising on-site content recommendations, in-product prompts, marketing emails, promotional offers, and editorial features.
- Generating market-insight content (for example: “most-watched skills on myjob.mt this month”) for publication on the Site, in newsletters, on social media, and in press materials.
Personal data is processed in accordance with our Privacy Policy. By creating, configuring, or maintaining an Alert, the Candidate consents to the uses set out above to the extent any such use requires consent under applicable law.
10. Chargebacks & payment disputes
The User agrees to contact us at hello@myjob.mt to resolve any payment dispute (whether arising from a Listing purchase, an Alert Time-Block purchase, or any other payment) before initiating a chargeback, payment reversal, or dispute with their bank or payment provider.
If a User initiates a chargeback or payment dispute without first contacting us and attempting resolution in good faith, we reserve the right to:
- Immediately and permanently suspend or terminate the User's account.
- Remove all active Job Listings and revoke any active Alert Time-Block entitlements associated with the account.
- Charge an administrative fee of up to €50 to cover processing costs incurred by the chargeback.
- Pursue recovery of all amounts owed, including administrative fees and legal costs, through all available legal remedies.
- Permanently prohibit the User and associated entities from future use of the Site.
We maintain detailed records of all transactions, including timestamped Terms acceptance logs, IP addresses, confirmation emails, and publication records, which may be used as evidence in the event of a dispute.
11. Listing duration & removal
Each paid Listing remains live on the Site for up to 30 days from the date of publication, unless removed earlier by the Recruiter or by us.
We reserve the right to remove any Listing at any time, without notice and without refund, if we determine in our sole discretion that the Listing violates these Terms, applicable law, or is otherwise harmful, misleading, or objectionable. Removal of a Listing for any reason does not entitle the Recruiter to any refund, credit, or compensation. The Recruiter remains responsible for all fees.
After the 30-day period, the Listing will be automatically deactivated. The permanent URL for the Listing will continue to exist but will no longer appear in search results or on the Site's public pages.
12. No guarantee of results
We do not guarantee any outcomes whatsoever from using the Site. Without limitation, we do not guarantee:
- That any Listing will receive any views, clicks, or applications.
- That any Candidate will find employment through the Site.
- That any Alert (free or paid) will produce a matching email in any given period, or that any matched Listing will be relevant, available, or accurate.
- That Job Listings are accurate, legitimate, legal, or from verified employers.
- That the Site, the matching pipeline, or any email-delivery infrastructure will be available without interruption, delay, or error.
- Any specific level of traffic, exposure, search engine ranking, or visibility for any Listing.
- The identity, qualifications, suitability, or reliability of any Recruiter or Candidate.
The Site and all content on it are provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
13. Disclaimer: listing accuracy, identity & fraud
We do not verify, endorse, or guarantee the accuracy, completeness, legitimacy, or lawfulness of any Job Listing, company identity, or Recruiter account on the Site. Job Listings are created and submitted entirely by third-party Recruiters. We do not perform background checks, identity verification, company verification, or due diligence on Recruiters, the companies they claim to represent, or any information they provide.
Without limitation, we accept no responsibility or liability for:
- Any Recruiter posting under a company name, trading name, or brand that they are not authorised to use or that does not accurately represent the actual employer.
- Fraudulent, fake, misleading, discriminatory, or illegal Job Listings.
- Any misrepresentation of salary, job title, working conditions, location, or any other aspect of a role.
- Any interaction, communication, or transaction between Recruiters and Candidates, whether on or off the Site.
- Any employment decision made by a Recruiter or Candidate based on information found on the Site.
- Any loss of personal data, identity theft, or financial loss suffered by a Candidate as a result of responding to a Listing.
Candidates are solely responsible for conducting their own due diligence before applying to any Listing, sharing personal information, or entering into any employment relationship. We strongly advise Candidates to:
- Verify the identity of the employer independently.
- Never send money, bank details, passwords, or identity documents to an employer through the Site or as a result of a Listing.
- Report suspicious Listings to us immediately at hello@myjob.mt.
We accept no responsibility or liability whatsoever for any loss, damage, cost, expense, or harm of any kind arising directly or indirectly from fraudulent, misleading, inaccurate, unauthorised, or illegal Job Listings posted on the Site.
14. Limitation of liability
To the maximum extent permitted by applicable law, MyJob.mt, its owners, directors, officers, employees, agents, contractors, and affiliates (collectively, the “Released Parties”) shall not be liable for any:
- Indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, revenue, data, business opportunities, goodwill, reputation, or anticipated savings, regardless of whether such damages were foreseeable.
- Direct damages exceeding the total amount you have actually paid to us in the twelve (12) months immediately preceding the event giving rise to the claim (and in no event more than €49 for a single Listing-related claim, or the price of the relevant Alert Time-Block SKU for a single Alert-related claim).
- Damages arising from your use of or inability to use the Site, any content posted by third parties (including Job Listings), any interactions between Users, or any reliance on information obtained through the Site.
- Damages arising from unauthorised access to or alteration of your data, transmissions, or content.
- Damages arising from the conduct, whether online or offline, of any third party, including other Users of the Site.
- Damages arising from missed, delayed, mis-routed, or undelivered Alert emails, from changes to or interruption of the matching pipeline, or from any matching outcome (including false positives and false negatives).
This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, statute, or otherwise) and even if we have been advised of the possibility of such damages.
Nothing in these Terms excludes or limits liability that cannot be lawfully excluded or limited under Maltese or EU law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation by us, or any other liability that mandatory law does not permit to be excluded.
15. Indemnification
You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable legal fees and court costs) arising from or related to:
- Your use of, or conduct on, the Site or any violation of these Terms.
- Any content you submit, post, or transmit through the Site, including any Job Listing.
- Your violation of any applicable law, regulation, or third-party rights (including intellectual property rights, privacy rights, and employment laws).
- Any claim by a third party (including Candidates, employers, or regulatory authorities) arising from the content or accuracy of your Job Listing.
- Any dispute between you and another User of the Site.
- Any claim that a Listing posted by you is discriminatory, fraudulent, misleading, defamatory, or otherwise unlawful.
- Any unauthorised use of a company name, trademark, or brand identity in a Job Listing.
- Any data protection or GDPR violation arising from data you collect, process, or store through or in connection with the Site.
- Any claim arising from the Company exercising the marketing, promotion, and editorial rights set out in section 17, including any third-party claim of trademark, publicity, or moral-rights infringement based on content the User submitted to the Site.
This indemnification obligation survives the termination of your account and these Terms.
16. Intellectual property
All content, design, branding, logos, trademarks, database rights, software, and technology on the Site (excluding User-submitted content) are the property of MyJob.mt and are protected by copyright, database rights (EU Directive 96/9/EC), trademark law, and other intellectual property laws. You may not reproduce, distribute, modify, reverse-engineer, or create derivative works from our content without prior written consent.
By posting a Job Listing or other User-submitted content, the User grants the Company a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable licence to host, store, cache, display, reproduce, adapt, translate, summarise, paraphrase, excerpt, modify, distribute, and promote the content on the Site, in emails, newsletters, search engine results, social media, paid advertising, press materials, podcasts, partner channels, AI-generated summaries, and any other channel for the purpose of operating, monetising, and promoting the Service. This licence survives removal of the Listing for the limited purpose of archival, cached, indexed, and previously distributed copies.
AI-generated summaries, tags, and other derived content produced by the Company from a User's submission are the Company's property and the Company may use them independently of, and after the removal of, the underlying Listing.
17. Marketing, promotion & editorial freedoms
Editorial licence (default).In addition to the licence granted in section 16, the User grants the Company a non-exclusive, worldwide, royalty-free, sublicensable licence to feature, reproduce, summarise, paraphrase, excerpt, and distribute any Job Listing, alert preview, screenshot, or statistic submitted to or generated by the Site for the Company's own non-paid editorial and informational purposes, including:
- Editorial content on the Site, including round-ups, “featured roles”, “jobs of the week”, “most-watched skills”, hiring-trend posts, and similar formats.
- Email newsletters and in-product notifications sent to Site users and subscribers.
- Organic (non-paid) posts on the Company's own social-media channels that describe the Listing in narrative form.
- Press releases, partner content, podcast episodes, and founder commentary that describe Listings or hiring trends in narrative form.
- Aggregate and anonymised market-trend content drawn from alerts, search behaviour, and Listing activity, where individual Recruiters are not identifiable.
Paid advertising and named-brand use (consent required). The Company will notuse a Recruiter's company name, trading name, logo, or branded Listing screenshot in paidadvertising (paid social, paid search, paid display, sponsored content, partner co-marketing, or comparable channels) without the Recruiter's prior, explicit consent. Consent may be given via a posting-time opt-in (where the Site offers one) or in writing to hello@myjob.mt. Consent may be withdrawn at any time on a prospective basis by emailing the same address. Withdrawal does not require the Company to retract or recall content already published, scheduled, indexed, cached, or distributed by third parties.
Editorial discretion. The Company has sole editorial discretion over how, when, where, whether, in what tone, and in what context to feature any Listing or content in any promotional surface, within the scope of the licence and/or consent set out above. We may choose to feature, omit, condense, rephrase, summarise, or pair content with commentary at our discretion. We are not obligated to feature any Listing in any channel, and decisions about featuring are not part of the paid Service. No User is entitled to any specific level of promotion, visibility, framing, frequency, or feature placement.
No liability for promotional placement.Within the scope of the licence and/or consent set out above, the Company accepts no responsibility or liability for any consequence of any promotional placement, including but not limited to: changes in social-media platform reach, ranking, or algorithm behaviour; the timing, ordering, framing, or pairing of any post; perceived endorsement, affiliation, or ranking implied by inclusion or exclusion; competitor Listings appearing alongside the User's own; or third-party reaction to or commentary on the content.
Editorial opt-out. A Recruiter who does not wish a specific Listing to be featured under the default editorial licence may request opt-out by emailing hello@myjob.mt with the Listing URL. We will honour the request on a prospective basis within a reasonable period. We cannot retroactively remove, recall, or alter content already published, scheduled, indexed, cached, or distributed by third parties.
18. Prohibited conduct
You agree not to:
- Post false, misleading, fraudulent, deceptive, or discriminatory Job Listings.
- Post a Job Listing using a company name, trading name, or brand identity that you are not authorised to use or that does not accurately represent the actual hiring organisation.
- Circumvent the one-Listing-per-role requirement.You shall not use a single paid Listing to advertise more than one open position, to advertise an unspecified set of “any open roles”, or to redirect Candidates to a generic careers page, talent pool, application portal, or expression-of-interest form covering roles other than the one described in the Listing. Bundling multiple positions into a single purchase, using vague or catch-all job titles or descriptions to recruit for unrelated positions, or otherwise circumventing the per-Listing fee constitutes a material breach of these Terms. Without limiting our other remedies, such conduct may result in immediate removal of the Listing without refund, suspension or termination of the Recruiter's account, permanent prohibition on the Recruiter and any associated entities or individuals from future use of the Site, and permanent discontinuation of business activitiesbetween the Company and the Recruiter. The Company may also recover, by way of liquidated damages, an amount equal to the €49 Listing fee for each additional position identified as having been advertised through the non-compliant Listing. Express written exemptions issued in advance under section 7 are the sole permitted exception.
- Scrape, crawl, spider, index, or harvest data from the Site by automated means (including bots, scripts, or AI training tools) without our prior written permission.
- Use the Site to distribute spam, malware, phishing attempts, or unsolicited communications of any kind.
- Attempt to gain unauthorised access to the Site, User accounts, databases, or our systems.
- Interfere with or disrupt the proper functioning, security, or integrity of the Site.
- Use the Site for any purpose that violates applicable law or these Terms.
- Resell, sublicence, or commercially exploit the Site, its content, Alert Time-Blocks, or Job Listing data.
- Post Listings for multi-level marketing, pyramid schemes, commission-only roles disguised as employment, adult content, or any unlawful activity.
- Create multiple accounts to circumvent a suspension, termination, or ban.
- Impersonate any person, entity, or organisation.
Violation of this section may result in immediate account termination, Listing removal, and forfeiture of any active Alert Time-Block entitlements without refund, without notice, and without liability.
19. Notice and takedown
If you believe that a Job Listing or any content on the Site is illegal, fraudulent, infringes your rights, or violates these Terms, you may report it to us at hello@myjob.mt. Please include a description of the content, its URL, and the reason you believe it should be removed.
We will review reports in a timely manner and take appropriate action, which may include removing or restricting access to the content. Where we remove or restrict content, we will provide the Recruiter with a statement of reasons, unless doing so would compromise an investigation or violate applicable law.
Submitting a report does not guarantee removal. We assess each report at our sole discretion. Removal of content does not entitle the Recruiter to any refund.
20. Third-party services
The Site integrates with third-party services including but not limited to Google (authentication), Stripe (payment processing), Resend (email delivery), Anthropic (AI tagging and matching), and Vercel (hosting). These services are governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, performance, or conduct of any third-party service, including but not limited to failed or delayed payment processing, email deliverability, or AI-model output quality.

21. Data protection & privacy
Your use of the Site is also governed by our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference.
Recruiters acknowledge that they are independent data controllers (within the meaning of GDPR Article 4(7)) with respect to any personal data they collect, receive, or process through or in connection with the Site (including Candidate applications and CVs). Recruiters are solely responsible for complying with GDPR, Malta's Data Protection Act (Cap. 586), and all applicable data protection legislation in respect of such data.
Recruiters agree not to request, collect, or process personal data through Job Listings that is excessive, discriminatory, or unlawful, and to include appropriate privacy notices in their hiring processes.
22. Availability & modifications
We do not guarantee that the Site will be available at all times, in all locations, or free from errors, bugs, viruses, or security vulnerabilities. We may modify, suspend, or discontinue any part of the Site at any time without notice or liability.
We may perform scheduled or emergency maintenance that results in temporary downtime. No compensation, credit, extension, or refund will be provided for any period of unavailability, regardless of its duration or cause.
23. Termination
We may terminate or suspend your access to the Site and your account immediately, without prior notice or liability, at our sole discretion, including if you breach these Terms. Upon termination, your right to use the Site ceases immediately.
Termination or suspension of your account does not entitle you to any refund of fees already paid (whether for Listings or Alert Time-Blocks). Any active Job Listings may be removed and any active Alert Time-Block entitlement may be revoked at our discretion upon termination.
Sections that by their nature should survive termination shall survive, including but not limited to: Definitions, Business Capacity Representation, No Refunds (both Listings and Alert Time-Blocks), Chargebacks, Limitation of Liability, Indemnification, Intellectual Property, Marketing & Promotion, Governing Law, and any accrued obligations.
24. Force majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, acts of government, war, terrorism, civil unrest, internet or telecommunications outages, cyberattacks, power failures, third-party service failures (including hosting, payment, email-delivery, and AI providers), and changes in applicable law or regulation.
25. Governing law & jurisdiction
These Terms are governed by and construed in accordance with the laws of Malta, without regard to its conflict of laws principles. Any dispute arising from or relating to these Terms, your use of the Site, or any transaction conducted through the Site shall be subject to the exclusive jurisdiction of the courts of Malta.
Before commencing any legal proceedings, the parties agree to attempt to resolve any dispute through good-faith negotiation for a period of thirty (30) days from the date written notice of the dispute is received by the other party.
26. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be severed and the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.
27. Waiver
No failure or delay by us in exercising any right, power, or remedy under these Terms shall operate as a waiver of that right, power, or remedy. A single or partial exercise of any right shall not preclude further exercise of that or any other right.
28. Entire agreement
These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and MyJob.mt regarding your use of the Site and supersede all prior agreements, understandings, representations, and communications, whether written or oral.
